These Terms of Service (“Terms”) govern your use of the websites, customer portal, and services provided by Foundation Debt Resolution, LLC, doing business as The Home Programs (“we,” “us,” or “our”). By creating an account or otherwise using our services, you agree to these Terms.
1. What we are and what we are not
The Home Programs is an informational, educational, and matching platform. We help you understand the routes to homeownership that fit your financial situation — and, when relevant, we introduce you to licensed lenders, brokers, credit-monitoring providers, and housing partners.
We are not:
- a real estate brokerage;
- a mortgage lender or mortgage broker;
- a credit-repair organization;
- a debt-settlement company performing legal services;
- a law firm or a substitute for legal advice; and
- a financial advisor. Results depend on your personal financial circumstances and on the conduct of third parties we cannot control.
2. Eligibility and your account
You must be at least 18 years old and able to enter into a binding contract to create an account. You agree to provide accurate information and to keep it current. You are responsible for the activity that happens through your account. Keep your login credentials confidential and contact us promptly if you suspect unauthorized access.
3. The program you enroll in
Depending on the program you enroll in (debt settlement, credit repair, rent-to-own, or our in-house path), separate enrollment documents will govern the specific services you receive, fees, cancellation rights, and program-specific disclosures required by law. Those program agreements control if they conflict with these Terms on a program-specific point.
4. Acceptable use
You agree not to:
- use the portal in a way that violates applicable law or these Terms;
- submit false information, impersonate another person, or attempt to access another person’s account;
- scrape, reverse-engineer, decompile, or otherwise interfere with the portal or its security features;
- upload viruses, malware, or content that infringes someone else’s rights;
- copy or republish content from the portal for commercial purposes without our written permission.
5. Communications consent
By providing your phone number and email, you consent to receive transactional and program-related communications from us by phone, SMS, and email. Marketing communications require separate consent and can be revoked at any time by replying STOP to a text, clicking unsubscribe in an email, or calling (833) 777-3323. Standard message and data rates may apply.
6. Electronic signatures and records
You consent to receive disclosures, agreements, and notices in electronic form, and you agree that your typed-name signature satisfies any signature requirement. You can request a paper copy of any signed document by calling (833) 777-3323.
7. Payments and authorizations
If you authorize recurring debits for an enrolled program, you authorize us and our payment processor to initiate the debits described in your enrollment documents. You may revoke an ACH authorization in accordance with applicable law and your enrollment agreement; revocation does not relieve you of obligations that accrued before revocation. Payment processing failures may result in fees as disclosed in your enrollment documents.
8. Third-party services and listings
The portal may surface listings, programs, or service providers offered by third parties. We do not control those third parties, and we make no warranty about their offerings. Your dealings with them are between you and them, including any terms, pricing, eligibility, or warranty they offer.
9. Intellectual property
We retain all rights, title, and interest in our trademarks, logos, software, content, and the portal. We grant you a limited, revocable, non-transferable license to use the portal for its intended purpose. You retain rights in the information you provide to us, and you grant us the licenses described in our Privacy Policy in order to deliver the services.
10. No guarantees
We do not guarantee any particular outcome — including approval for a mortgage, a specific credit-score increase, a settlement amount, a successful purchase, or any specific timeline. The services depend on facts about your finances, on third parties, and on conditions outside our control.
11. Disclaimers
The portal and services are provided “as is” and “as available” to the maximum extent permitted by law. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so some of these disclaimers may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the services is limited to the amount you paid us in the 12 months before the event giving rise to the claim, or one hundred US dollars ($100), whichever is greater. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
13. Indemnification
You agree to indemnify and hold us, our affiliates, and our officers, employees, and agents harmless from any claim, damages, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your misuse of the services.
14. Termination
You may stop using the portal at any time. We may suspend or close your account if you breach these Terms or if we close the services generally. Termination of the portal does not end any enrollment agreement you have signed — those are governed by their own cancellation provisions.
15. Dispute resolution — informal first
Before filing a formal claim, you agree to email us at legal@thehomeprograms.com and give us 60 days to try to resolve the issue informally. Most disputes can be settled this way.
16. Binding arbitration and class-action waiver
Please read this section carefully — it limits how you can pursue claims against us.
Except for small-claims-court matters and disputes about intellectual property, you and we agree that any dispute arising out of or relating to these Terms or the services will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitrator’s decision will be final, except as judicial review is permitted by the Federal Arbitration Act.
Class-action and jury-trial waiver. You and we agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, or consolidated action. There is no judge or jury in arbitration.
Opt-out. You can opt out of this arbitration section within 60 days of first agreeing to these Terms by sending written notice to legal@thehomeprograms.com with the subject line “Arbitration opt-out” and including your name, address, and account email. Opting out of arbitration does not affect any other part of these Terms.
17. Governing law and venue
These Terms and any dispute arising out of them are governed by the laws of the State of Utah, without regard to conflict-of-law principles. For matters not subject to arbitration, the exclusive venue is the state and federal courts located in Utah.
18. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top. If changes are material, we will give you reasonable advance notice — for example, by email or a banner in the portal — before they take effect. Continuing to use the services after changes take effect means you accept the updated Terms.
19. Miscellaneous
These Terms, together with the program-specific agreements you sign at enrollment and our Privacy Policy, are the complete agreement between you and us regarding the services. If any provision is held unenforceable, the remaining provisions stay in effect. Our failure to enforce a right is not a waiver of that right. You may not assign your rights under these Terms; we may assign ours in connection with a merger, acquisition, or sale of assets.
